Regulations on Safety Supervision of Large-scale Amusement Facilities


Chapter 1 General Provisions

Article 1 For the purpose of strengthening the safety supervision of large-scale amusement facilities, preventing and reducing accidents, and ensuring the safety of persons and property, these Regulations are formulated in accordance with the "People's Republic of China Special Equipment Safety Law" and the "Regulations on the Safety Supervision of Special Equipment".

Article 2  The design, manufacture, installation, transformation, repair, use, inspection, testing, and supervision and inspection of large-scale amusement facilities shall comply with these Regulations.

Article 3  The State Administration for Market Regulation is responsible for the comprehensive management of the national safety supervision of large-scale amusement facilities, and the market supervision and administration departments at or above the county level are responsible for the safety supervision of large-scale amusement facilities within their respective administrative regions.

Article 4  Special equipment inspection institutions engaged in the identification of design documents, type testing, supervision inspection, and periodic inspection of large-scale amusement facilities shall be legally approved before engaging in the corresponding activities, and shall be responsible for their identification conclusions and inspection results.

Article 5  Manufacturing, installation, transformation, and repair units of large-scale amusement facilities shall obtain legal permits before engaging in the corresponding activities, and shall be responsible for the safety performance of the large-scale amusement facilities they manufacture, install, transform, and repair.

The operation and use units of large-scale amusement facilities are responsible for the safety of the large-scale amusement facilities they use.

Article 6  It is encouraged to implement the relevant liability insurance system for large-scale amusement facilities to improve the ability of accident emergency handling and compensation.


Chapter 2 Design, Manufacture, and Installation of Large-scale Amusement Facilities

Article 7  Manufacturing units shall conduct safety assessments of the design of large-scale amusement facilities and propose safety risk prevention and control measures.

For new technologies used for the first time, manufacturing units shall verify their safety performance.

Article 8  Manufacturing units shall clearly indicate the design service life of the complete machine and main load-bearing components of large-scale amusement facilities.

For components that need to be inspected, tested, or replaced within the design service life of the complete machine, they shall be designed as detachable structures; for components that cannot be designed as detachable structures, their design service life shall not be less than the design service life of the complete machine.

Article 9  After the completion of the design of large-scale amusement facilities, the manufacturing unit shall apply to the special equipment inspection institution for design document identification in accordance with the law.

The special equipment inspection institution shall conduct design document identification in accordance with the requirements of safety technical specifications.

Article 10  Manufacturing units shall manufacture in accordance with the design documents, standards, safety technical specifications, etc.

If a manufacturing unit entrusts the processing of components or purchases components from outside, it shall strengthen quality control and bear legal responsibilities in accordance with its quality system requirements.

Article 11  For large-scale amusement facilities or trial-produced new products of large-scale amusement facilities that require type testing in accordance with safety technical specifications, the manufacturing unit shall apply to the special equipment inspection institution for type testing in accordance with the law.

Before applying for type testing, the manufacturing unit shall formulate a test plan for the trial-produced new products of large-scale amusement facilities and conduct safety performance tests.

Article 12  When large-scale amusement facilities leave the factory, they shall be accompanied by documents such as quality certificates for main load-bearing components, design document identification reports, installation and use and maintenance instructions. Mobile large-scale amusement facilities shall also be accompanied by disassembly instructions.

Article 13  The use and maintenance instructions for large-scale amusement facilities shall clearly specify the conditions of use, technical parameters, operating procedures, passenger notices, test run inspection items, personnel requirements, daily and periodic inspection items of equipment, maintenance items and requirements, common faults and troubleshooting methods, accident emergency handling plans, design service life of the complete machine and main load-bearing components, detection of main load-bearing components and replacement cycle and methods of wearing parts, etc.

Article 14  Before installation construction, the installation unit shall confirm that the site, equipment foundation, embedded parts, and other civil engineering works meet the requirements of civil engineering quality supervision management.

Article 15  Before construction, the installation unit shall inform the market supervision and administration department of the municipality directly under the Central Government or the market supervision and administration department of the city with districts under its jurisdiction in writing of the planned installation of large-scale amusement facilities. Construction may commence after notification.

For the re-installation of mobile large-scale amusement facilities, the installation unit shall inform the market supervision and administration department of the municipality directly under the Central Government or the market supervision and administration department of the city with districts under its jurisdiction in accordance with the regulations before construction.

Article 16  The installation unit shall implement the quality management system and management system, strictly operate in accordance with the design documents, standards, safety technical specifications, construction plans, etc., and strengthen on-site construction quality management.

The on-site personnel of large-scale amusement facilities installation construction shall meet the construction requirements.

Article 17  The installation process of large-scale amusement facilities shall be subject to installation supervision and inspection by special equipment inspection institutions based on the enterprise's self-inspection, in accordance with the scope, items, and requirements stipulated in the safety technical specifications; those that have not passed the installation supervision and inspection shall not be put into use; operation and use units shall not use large-scale amusement facilities that have not passed the installation supervision and inspection.

Article 18  After the completion of the installation of large-scale amusement facilities, the installation unit shall install nameplates that meet the requirements of safety technical specifications in conspicuous parts of the large-scale amusement facilities.

The installation unit shall, within 30 days after acceptance, transfer the factory random documents, type test qualification certificate, installation supervision inspection and non-destructive testing report, as well as the installation quality certificate confirmed by the manufacturing unit, product quality certificate, debugging and trial operation record, self-inspection report and other installation technical data to the operation and use unit for archiving.


Chapter 3 Use of Large Amusement Facilities

Article 19  Before putting large amusement facilities into use or within 30 days after putting them into use, the operation and use unit shall register with the market supervision and administration department of the municipality directly under the Central Government or the city with districts.

For mobile large amusement facilities, the operation and use unit shall register with the market supervision and administration department of the municipality directly under the Central Government or the city with districts before putting them into use each time they are reinstalled or within 30 days after putting them into use; after the mobile large amusement facilities are dismantled, the cancellation procedures shall be handled with the original registration department.

The operation and use unit shall place the registration mark in a conspicuous place, such as the entrance and exit of the large amusement facility.

Article 20  The operation and use unit shall submit an application for the first periodic inspection to the special equipment inspection institution within one year after the completion of the installation supervision inspection of the large amusement facility; one month before the expiration of the periodic inspection cycle of the large amusement facility, the operation and use unit shall submit a request for periodic inspection to the special equipment inspection institution.

The special equipment inspection institution shall conduct periodic inspections in accordance with the requirements of the safety technical specifications.

Article 21  The operation and use unit shall establish and improve a safety management system. The safety management system shall include the following main contents:

(1) Technical file management system;

(2) Safe operation procedures;

(3) Daily safety inspection system;

(4) Maintenance system;

(5) Regular inspection system;

(6) Code of conduct for operators and service personnel;

(7) Safety training and assessment system for operators and relevant operation service personnel;

(8) Emergency rescue drill system;

(9) System for handling unexpected events and accidents;

(10) Others.

Article 22  The operation and use unit shall establish a technical file for each large amusement facility and manage and preserve it in accordance with the law. The technical file shall include the following main contents:

(1) Installation technical data;

(2) Supervision inspection report;

(3) Use registration form;

(4) Modification and repair technical documents;

(5) Records of annual self-inspection;

(6) Periodic inspection report;

(7) Emergency rescue drill records;

(8) Records of operation, maintenance, equipment failures and accident handling;

(9) Records of operator training, assessment and certificate management;

(10) Other contents prescribed by laws and regulations.

Article 23  The operation and use unit shall conduct pre-operation inspection, daily inspection and maintenance, and regular safety inspection in accordance with the requirements of safety technical specifications and operation and maintenance instructions, and make true records. Any abnormal situations found in self-inspections such as daily maintenance and pre-operation inspections shall be dealt with promptly. Before national statutory holidays or large-scale mass activities, the operation and use unit shall conduct a comprehensive inspection and maintenance of large amusement facilities, and strengthen daily inspections and safety duty.

The operation and use unit shall, in carrying out the maintenance work of its equipment, equip operators with corresponding qualifications, necessary tools and equipment in accordance with the requirements of safety technical specifications.

Article 24  The operation and use unit shall post passenger notices, safety precautions and warning signs in conspicuous places such as the entrance of large amusement facilities, indicating the movement characteristics of the equipment, passenger range, prohibited matters, etc.

Article 25  The operation and use unit shall formulate emergency plans, establish an emergency rescue command institution, and equip corresponding rescue personnel, rescue equipment and first-aid supplies. A special emergency plan shall also be formulated for each large amusement facility.

The operation and use unit shall strengthen the storage and management of rescue equipment and first-aid supplies, regularly conduct professional training for rescue personnel, and organize at least one emergency rescue drill per year for each large amusement facility.

The operation and use unit may, according to the actual local conditions, establish an emergency linkage mechanism with other operation and use units or professional emergency rescue forces such as fire rescue, formulate joint emergency plans, and conduct regular joint drills.

Article 26  The legal representative or person in charge of the operation and use unit is responsible for the safe use and management of large amusement facilities.

Article 27  The operation and use unit shall set up a special safety management institution and equip safety management personnel, or equip full-time safety management personnel, and ensure that at least one safety management personnel is on duty during the operation of the equipment.

The operation and use unit, safety management institution and safety management personnel shall perform the following duties:

(1) Responsible for checking the implementation of various safety management systems of the unit;

(2) Responsible for formulating and implementing equipment maintenance and safety inspection plans;

(3) Responsible for daily inspection of equipment use status, investigation of accident hidden dangers, and if problems are found, the equipment shall be stopped and the relevant person in charge of the unit shall be reported promptly;

(4) Responsible for organizing equipment self-inspection, application for use registration and periodic inspection;

(5) Responsible for organizing emergency rescue drills;

(6) Responsible for organizing safety education and training for personnel of the unit;

(7) Responsible for the management of technical files.

Article 28  Operating and using entities should, in accordance with safety technical specifications and operation and maintenance manuals, equip themselves with licensed operators who meet safety operation requirements, and strengthen pre-job training and education for service personnel, enabling them to master basic emergency skills and assist operators in emergency response.

Operators shall perform the following duties:

(1) Strictly abide by operating procedures and operator codes of conduct;

(2) Before each operation, passengers should be informed of safety precautions, and safety devices for protecting passengers should be inspected and confirmed;

(3) During operation, close attention should be paid to passenger dynamics and equipment operating status. If abnormal situations are found, effective measures should be taken immediately to eliminate safety hazards;

(4) Be familiar with emergency rescue procedures. In case of a malfunction or sudden incident, operations should be stopped immediately or emergency measures taken to protect passengers, and the on-site safety management personnel should be reported to immediately;

(5) Accurately record the operating status of the equipment.

Article 29  If large amusement facilities are modified, the modification unit shall redesign them, conduct design document appraisal, type testing, and supervision inspection in accordance with these regulations, and be responsible for the quality and safety performance of the modified equipment.

Before construction, the unit modifying large amusement facilities shall provide written notification of the planned modification of the large amusement facilities to the market supervision and administration department of the municipality directly under the Central Government or the city divided into districts. Construction may commence after notification.

After the modification of large amusement facilities is completed, the construction unit shall install a nameplate that meets the requirements of safety technical specifications, and within 30 days after acceptance, transfer the technical data meeting the requirements of Article 18 to the operating and using entity for archiving.

Article 30  Repair and major repair of large amusement facilities shall be carried out in accordance with safety technical specifications and operation and maintenance manual requirements. Before construction, the large amusement facility repair unit shall provide written notification of the planned repair of the large amusement facilities to the market supervision and administration department of the municipality directly under the Central Government or the city divided into districts. Construction may commence after notification.

During the major repair process, a special equipment inspection agency must conduct a major repair supervision inspection in accordance with the requirements of safety technical specifications; equipment that has not passed the major repair supervision inspection shall not be delivered for use; operating and using entities shall not, without authorization, use large amusement facilities that have not passed the major repair supervision inspection.

After the repair of large amusement facilities is completed, the construction unit shall transfer the self-inspection report and other repair-related materials of the large amusement facilities to the operating and using entity for archiving; after the major repair of large amusement facilities is completed, the construction unit shall transfer the self-inspection report, supervision inspection report, and non-destructive testing report of the large amusement facilities to the operating and using entity for archiving.

Article 31  Personnel engaged in modification and major repair of large amusement facilities at the construction site shall meet construction requirements, and the number of personnel with corresponding special equipment operation qualifications shall comply with the requirements of safety technical specifications.

Article 32  In the event of an accident involving large amusement facilities, the operating and using entity shall immediately cease use and promptly report to the local market supervision and administration department at or above the county level in accordance with relevant regulations.

For faults or accidents caused by design, manufacturing, or installation reasons, where there are hidden dangers related to quality and safety issues, the manufacturing and installation unit shall investigate similar types of equipment to eliminate the hidden dangers.

Article 33  For large amusement facilities that have exceeded their overall designed service life but still have repair or modification value and can continue to be used, the operating and using entity shall undergo inspection or safety assessment in accordance with the requirements of safety technical specifications and handle the change of the use registration certificate. The operating and using entity shall strengthen the management of large amusement facilities permitted for continued use, take measures such as strengthening inspection, testing, and maintenance, and increase the frequency of comprehensive self-inspection to ensure safe use.

If the main load-bearing components of large amusement facilities exceed their designed service life requirements and do not meet the conditions for safe use after inspection or safety assessment, they shall be replaced in a timely manner.

Article 34  If an operating and using entity leases a venue to operate large amusement facilities, it shall sign a safety management agreement with the venue provider and implement safety management systems.

The venue provider shall verify that the operating and using entity of the large amusement facilities meets the operating and use conditions required by relevant laws and regulations and these regulations.


Chapter 4 Supervision and Inspection

Article 35  Market supervision and administration departments shall conduct supervision and inspection of production and use entities and inspection and testing agencies of large amusement facilities in accordance with the "Law of the People's Republic of China on Special Equipment Safety," "Regulations on Safety Supervision of Special Equipment," and other relevant requirements of these regulations.

Article 36  Before conducting inspections, special equipment inspection agencies shall notify the market supervision and administration department responsible for use registration. After the inspection is completed, the supervision inspection and periodic inspection reports shall be filed with the market supervision and administration department responsible for use registration.

Inspection personnel shall issue written inspection opinions to the inspected unit in accordance with safety technical specifications and submit them to the market supervision and administration department responsible for use registration. If the site does not meet inspection conditions, a written explanation of the relevant situation shall be issued to the inspection applicant unit.

Article 37  The investigation and handling of large amusement facility accidents shall be carried out in accordance with the provisions of laws and regulations.


Chapter 5 Legal Responsibilities

Article 38  If a large amusement facility manufacturing or installation unit violates these regulations and falls under any of the following circumstances, a warning shall be issued, and a fine of not less than 10,000 yuan but not more than 30,000 yuan shall be imposed:

(1) Failing to conduct a safety evaluation of the design and propose safety risk prevention and control measures;

(2) Failing to verify the safety performance of new technologies used for the first time in the design;

(3) Failing to specify the designed service life of the entire machine and its main load-bearing components;

(4) Failing to install a nameplate that meets the requirements of relevant safety technical specifications in a prominent part of the large amusement facility;

(5) Failing to investigate and handle hidden dangers related to quality and safety issues caused by design, manufacturing, or installation reasons, in accordance with the requirements of these regulations.

If the contents of factory documents such as operation and maintenance manuals do not comply with the requirements of these regulations, they shall be handled in accordance with Article 77 of the "Law of the People's Republic of China on Special Equipment Safety."

Article 39  If a large amusement facility modification unit violates these regulations by failing to conduct design document appraisal, a warning shall be issued, and a fine of not less than 10,000 yuan but not more than 30,000 yuan shall be imposed.

Article 40  Large amusement facilities operating units that violate these regulations in any of the following circumstances will receive a warning and a fine of RMB 10,000 to 30,000:

(1) Failure to replace major load-bearing components that have exceeded their design service life and do not meet the conditions for safe use after inspection or safety assessment;

(2) For those operating large amusement facilities by leasing venues, failure to sign a safety management agreement with the venue provider and implement safety management systems;

(3) Failure to conduct major repairs in accordance with safety technical specifications and operating and maintenance instructions.

If there is no safety management personnel on duty during equipment operation, or if the number of certified operators does not meet the requirements for safe operation, it will be handled in accordance with Article 86 of the "People's Republic of China Special Equipment Safety Law".

Article 41  If the number of personnel at the construction site for installation, modification, and major repair work violates these regulations and does not meet the construction requirements, or if the number of personnel with the corresponding special equipment operation qualifications does not meet the requirements of the safety technical specifications, a warning will be given, and a fine of RMB 5,000 to 10,000 will be imposed.

Article 42  Violations of these regulations that constitute illegal acts as defined in the "People's Republic of China Special Equipment Safety Law", the "Regulations on the Safety Supervision and Inspection of Special Equipment", etc., will be punished according to their provisions.


Chapter 6 Supplementary Provisions

Article 43  As used in these regulations, "large amusement facilities" refers to facilities used for commercial purposes and carrying passengers for amusement, as defined in the "Regulations on the Safety Supervision and Inspection of Special Equipment". The scope is defined as manned large amusement facilities with a design maximum operating linear speed greater than or equal to 2 m/s, or an operating height above the ground greater than or equal to 2 m.

Mobile large amusement facilities refer to large amusement facilities without dedicated civil engineering foundations, which are easy to disassemble, move, and transport.

Article 44  The meanings of the following terms used in these regulations are:

Operating unit refers to enterprises and individual businesses engaged in the daily operation and management of large amusement facilities and registered for use with the market supervision and administration department.

Modification refers to activities that change the main load-bearing components, main materials, equipment movement form, important geometric dimensions, or main control system, resulting in changes to the main structure or performance parameters of the large amusement facility.

Maintenance refers to activities such as equipment component disassembly, inspection, system debugging, and replacement of wearing parts, but without changing the main structure or performance parameters of the large amusement facility, as well as activities such as tightening connecting parts, dust removal, and lubrication during daily inspections.

Repair refers to activities that involve equipment component disassembly, replacement, or repair of major load-bearing components, but without changing the main structure or performance parameters of the large amusement facility.

Major repair refers to activities that involve overall equipment disassembly, inspection, replacement, or repair of major load-bearing components, main control systems, or safety device functions, but without changing the main structure or performance parameters of the large amusement facility.

Article 45  These regulations shall come into force on January 1, 2014. In cases of inconsistencies between these regulations and the provisions on large amusement facilities in the "Regulations on the Quality Supervision and Safety Inspection of Special Equipment" issued by the former State Administration of Quality Supervision, Inspection and Quarantine on June 29, 2000, these regulations shall prevail.
